Terms of use

These terms govern use of Proof My Photos (the “Service”), operated by SECRET SERVICE LIMITED (company number 12945794).

Who we are

Proof My Photos is a trading name of SECRET SERVICE LIMITED, a company registered in England and Wales under company number 12945794 . We are not registered for VAT. For questions about these terms, cancellations or refunds, use the contact page.

The Service

Proof My Photos provides tools for professional photographers to publish public portfolios, create client proofing galleries, invite guests to view approved images, and sell prints or HD downloads. Features, pricing and third-party fulfilment partners may change as the product develops.

Accounts

  • You must provide accurate registration details and keep login credentials secure.
  • Photographer accounts are for professional use. Client, venue and guest logins only access the galleries they are invited to.
  • You must be old enough to enter a binding contract in the United Kingdom (usually 18+).
  • We may suspend or close accounts that breach these terms, create legal risk, or abuse the platform.

Photographer responsibilities

If you operate a studio account you are responsible for:

  • Owning or having rights to upload and display the photographs and text you publish.
  • Having an appropriate lawful basis to process images of people and any personal data of clients or guests.
  • Setting guest product prices at or above platform minimums and honouring orders placed through the Service.
  • The content of your public profile and the way you communicate with enquirers.
  • Complying with consumer law where you sell to consumers in the UK, and co-operating promptly with us on guest order queries, quality issues and refunds.

For photographs and client/guest personal data in your galleries, you are typically the data controller; we host and process that material on your instructions as described in the Privacy policy.

Guest purchases: who you buy from

When a guest buys prints or HD downloads through our checkout, payment is taken by SECRET SERVICE LIMITED trading as Proof My Photos (via Stripe). For those guest orders you contract with us for supply of the products shown at checkout. The photographer provides the images and sets the retail prices offered in their gallery. Physical prints may be produced and shipped by a third-party print partner using the delivery details you supply.

Platform fees paid by photographers (for example gallery fees or subscription plans) are separate contracts between the photographer and us.

Orders, payments and delivery

  • Guest orders and photographer platform fees are paid via Stripe.
  • Print orders may be fulfilled by a third-party lab using the delivery name and address supplied at checkout. Please check those details carefully before paying.
  • Estimated delivery times are indicative. Carrier delays and ordinary production variation can occur once an order is with the lab; that does not remove your rights if goods are faulty or not as described.
  • Digital (HD) downloads are supplied electronically after successful payment, subject to the licence terms shown at purchase.
  • Guest checkout may be completed without creating a full studio account, using the details you enter at checkout. Keep your order confirmation email so we can help you later.

Cancellations and the cooling-off period

If you are a consumer buying at a distance in the UK, you may have a legal right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Important product-specific points apply to our Service:

Customised / personalised prints

Prints ordered through the Service are made to your specification, for example the photograph you select, size, product type and finish, and the delivery details you provide. Goods made to a consumer’s specifications or clearly personalised are generally excluded from the statutory cooling-off right once they are made to that specification.

  • Before production starts: you may ask us to cancel a print line that has not yet been sent for production. If we can cancel it, we will refund what you paid for that item.
  • After production has started or the print has shipped: a change-of-mind cancellation and cooling-off refund will not usually be available for that personalised item. This does not affect your rights if the print is faulty, damaged in transit, or not as described.

HD digital downloads

HD downloads are digital content. Where you ask us to begin supply straight away and acknowledge that you will lose the cooling-off right once supply begins, that cancellation right ends when we make the file available to you (for example when download access is provided after payment). How to ask for a cancellation

Contact us via the contact page with your order reference, the email used at checkout, and what you want to cancel. We will confirm whether the item can still be stopped before production or whether another remedy applies.

Faulty goods, print quality and digital files

Under the Consumer Rights Act 2015, goods you buy as a consumer must be of satisfactory quality, as described, and fit for the purpose made known to the trader. Digital content must also meet applicable quality standards.

  • Print quality or damage: if a print arrives damaged, defective, misprinted, or materially different from the product description, tell us promptly with your order details and clear photographs of the issue (and packaging if relevant). Where a problem is made out, we will arrange a reprint or a refund as appropriate to the circumstances and your legal rights.
  • HD downloads: if a paid file will not download or is corrupt, contact us and we will re-supply it where reasonably possible, or refund if we cannot provide the digital content you paid for.
  • Ordinary print variation: small differences in colour or finish between a screen preview and a physical print can occur. That alone is not usually a fault, but a clear production defect or damage is.

Nothing in these terms excludes or limits your statutory rights. Commercial production costs do not remove those rights where goods or digital content are faulty or not as described.

Refunds

Where a refund is due (for example a cancelled item before production, a successful quality claim, or another case where law or these terms require it), we will refund via the original payment method where possible. Refund timing depends on your card issuer or payment provider after we process it.

If only part of an order is cancelled or faulty, we may refund that part rather than the whole order. Photographer payouts for an order may be held or adjusted where a guest payment is refunded or disputed; that is an arrangement between us and the photographer and does not reduce your consumer rights.

Acceptable use

You must not use the Service to:

  • Upload unlawful, infringing, harassing or exploitative content.
  • Attempt to bypass security, scrape private galleries, or interfere with other users.
  • Misrepresent your identity, studio or the nature of content you publish.
  • Use guest or client credentials except as authorised by the relevant photographer.

Intellectual property

Photographers retain ownership of their images. You grant us a limited licence to host, cache, watermark (where enabled), display and transmit content as needed to operate the Service and fulfil orders. Our branding, software and site design remain ours. HD purchases grant only the licence rights described at checkout, not ownership of the copyright.

Availability and liability

We aim for a reliable service but do not guarantee uninterrupted availability. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profits, data or goodwill. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under UK law, including your non-excludable consumer rights.

Changes

We may update these terms as the Service evolves. Material changes will be posted on this page with a revised date. Continued use after changes constitutes acceptance of the updated terms.

Governing law

These terms are intended to be governed by the laws of England and Wales, with courts in England and Wales having jurisdiction, subject to mandatory consumer protections that apply where you live.
